GENERAL DISCLAIMER

 

Adam Christopher Design Ltd will deal with the customer’s order in accordance with our obligations under the Sale of Goods Act 1979 (as amended), the Sale and Supply of Goods to Consumers Regulations 2002 and The Consumer Contracts Regulation 2014.

 

QUALITY

 

Our products have been designed and created for hand made construction and thus dimensions are an estimate. There will be slight variations between each product dimensions and form. By submitting the order the customer acknowledges their understanding of this and they are not machine precision accurate.

 

The material and manufacture techniques used by Adam Christopher Design Ltd may or may not expose surface air bubbles and visible fibres, these are considered to be a result of the material and the handmade techniques used to create the forms and are deemed ‘natural imperfections’ not as faults.

 

All the products made and manufactured by Adam Christopher Design Ltd will age and change their colour and or tone over time as a result of the weathering of the materials they are made from.

 

Concrete will leech a white powder in a process called efflorescence and this will effect the consistency of the tone over the product.

 

Surface treated options such as rust staining and other coatings are natural treatments and thus will have variations in surface colour, tone, depth and texture. As these are natural stains and coatings the customer acknowledges and accepts the variations prior to receipt of the product.

 

Rust and copper stains and coatings both leech their colour over time and will transfer that colour to anything they come into contact with. Any damage to any other surface, product or property as a result of not protecting them from this colour leech will be the sole responsibility of the customer and the supplier holds no responsibility for this.

 

 

If the customer is not satisfied with the quality of the ordered items(s)  Adam Christopher Design Ltd will, after inspection of the goods, follow a strict policy of Repair, Replace and finally Refund, depending on which remedy is the most appropriate.

In the case of a refund, you will be eligible for a full refund less the cost of any shipping charges for return of the goods. Adam Christopher Design retains ultimate discretion on whether a product is deemed faulty or not.

 

Whilst every effort is made to make all Adam Christopher pots water tight it is recommended that planters placed indoors have an additional sealer added to the interior walls and around the drainage hole plug to ensure there is no damage done to any surface the planter is placed on.

 

Due to the very complex shapes produced through Adam Christopher Design Ltd there will be mould lines on each pot which will be hand finished to reduce their appearance. Due to the chemical way in which concrete cures there may be a darkening of material around these areas.

 

LEGAL JURISDICTION

 

All our consumer contracts are governed by English law and shall fall under the exclusive jurisdiction of the courts of England. English is the official language offered for the conclusion of the contract.

The statement of our terms and conditions of trade is in accordance with your statutory rights under the legislation above.

 

TERMS & CONDITIONS OF PURCHASE

 

“Customer” means any person who is purchasing items from the Supplier.
“Supplier” means Adam Christopher Design

 

Ownership

Ownership of the Goods shall not pass over until the price of the purchased items has been paid and received in full for the Goods.

 

SUPPLIER’S OBLIGATIONS

 

The supplier warrants that the product description will correspond with the description logged by the customer at the time of purchase.

 

RISK OF LOSS

 

All purchases made with the supplier, are made in accordance with a shipping contract. By purchasing from the supplier, the customer agrees that the ownership and risk of loss for such items passes to themselves upon delivery of the items. If the items are not inspected at the time of delivery then it is requested that the customer notes on the delivery receipt that they were unchecked, failure to do this may result in any claims of damage being denied.

 

TERMS & CONDITIONS OF ORDER PLACEMENT, ORDER CHANGES, & RETURNS

 

Use of this website implies that all the terms and conditions in regards to orders placed, order placement and other issues concerning orders, as outlined here have been accepted and agreed to.

It is understood that a made to order product, once it has been submitted and subsequently processed, cannot be cancelled. Should it under some circumstances, be agreed by the Supplier to cancel an order, cancellation charges relevant to the product would be deducted from the submitted payment before a refund is issued or a charge back made to the card used for payment submission.

Customers have the right to cancel within 14 days on standard in stock item. In situations where standard items are not in stock and the order is made specifically for the customer a refund will not be issued once the deposit and or full amount has been submitted.

Any changes must be made to an order within 24 hours of placing the order; making a change within 24 hours of placing the order does not guarantee that a change can be made. The Supplier will, where possible, endeavour to make changes. All changes to an order, once the order has been processed and where a change remains possible, will carry a £20 change fee per change which is in addition to the difference in any charges associated with that change, be it changes to colours, styles, or any other aspect.

As each bespoke item is made to order, the Supplier is unable to resell an order to any Customer other than the Customer placing the order, and as such the Supplier cannot accept returns on the basis of a change of heart on the part of the Customer. Neither can the Supplier accept returns where the Customer requests a change to an existing order and the Supplier cannot fulfil that change. Where there is a dispute between Customer and Supplier over the styling of the order, the record on the Supplier’s ordering system is taken as the firm and final order.

 

TERMS & CONDITIONS OF DEADLINES AND DELIVERIES

 

It is understood that turnaround and dispatch of the orders placed at the Supplier may vary from time to time depending on current order volumes, work schedules, material availability or a particular characteristic of the order placed. The Supplier will try its best to comply with the expected delivery date from payment. Dispatch times may vary according to availability, any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure (including Acts of God, Acts of War or Acts of Terrorism) for which the supplier will not be responsible. The supplier will not be responsible for such delays resulting from situations within the recipient’s control, such as recipient not being available to accept delivery, or incorrect delivery details supplied.

 

DELIVERY & RETURNS

 

The delivery of your order may be restricted depending on the size, weight and chosen destination of the package. Other factors such as weather and mechanical difficulties can also result in later deliveries. If the delivery address is different to the billing address then we may have to run further checks to ensure your credit card security, this may result in longer delivery times. Delivery is £30 per pot to central UK mainland up to and including delivery zone 4 comprising of addresses with postcodes commencing:

We will send you an initial email confirming receipt of your order; then a further email confirming that your order is ready for dispatch. Where an item is made to order we will advise you of the anticipated time for delivery. Orders can be delivered to either business or residential addresses, however all packages will require a signature on receipt of delivery and must be accessible by pallet delivery services. It is customary for the dispatch companies we use to leave a notification card with their contact information if the delivery address is unattended at the time of delivery, however this may not always be the case. Adam Christopher Design cannot take responsibility if a notification card is not left in any instance.

 

DELIVERY CHARGES, AND TIMES

 

Delivery is £30 for each flower pot or tables sold through Adam Christopher design delivered to central UK mainland with addresses beginning with postcodes:

Should a return and refund be agreed then the customer can either arrange delivery themselves or incur a fee for pallet delivery back to the studio or distribution hub. The refund will be issued within 14 days of receipt of the product less the delivery charge if arranged by Adam Christopher Design Ltd.

Delivery of products is sometime subsidised to provide clarity for customers and a return delivery cost will not be the same as the initial delivery cost. Should the customer decide to arrange delivery themselves the product/products must be returned in exactly the same packaging and condition that it was sent.

Free delivery can sometimes be offered when multiple products are ordered but this is subject to the delivery address being in a standard delivery zone. For example delivery to the congestion zone in London will incur higher delivery rates along with harder to reach areas. Free delivery to these destination is on a case by case basis so please contact us if you are in doubt of your delivery addresses status.

These prices assume central mainland UK delivery, elsewhere please contact us for details. Estimated delivery times are displayed on the item page and will vary as all of our collection is made to order. After manufacturing of the ordered product or products has begun it cannot be cancelled or amended so before ordering any such items please be completely sure that you order what you require.

DAMAGED GOODS

 

Any goods that arrive damaged should be reported within 24 hours of receipt so that we can contact the courier. Any claim for damages later than 24 hours from receipt will not be entertained. If you do not check the condition of the item upon delivery it is required that you state on the delivery receipt form that it was unchecked. In the unfortunate event that the product is damaged we reserve the right to request photographs of the damage for our records.

 

RETURNS POLICY

 

For all returns the customer can either arrange and pay for the return of the products to us or have the cost taken from the refund.

To return any products to us, please email us first at info@adamchristopherdesign.com to advise that you would like to arrange a return or exchange and we can begin to examine your case.

We ask that all returns are adequately packaged, insured and protected to the standard they arrived or better to prevent any damage occurring during transit. Products damaged during return shipping will not be accepted.

You will receive your refund credit, cheque or exchange order (when in stock) within 14 working days of us receiving the goods. We endeavour to process this as quickly as possible.

Please note that we are unable to refund an item without a receipt and that the refund will only be given to the original payer.
